Cash prizes will be credited within 72 hours of the promotional period ending. Once credited, you will have seven days to accept your cash prize. You can accept your cash prize via the pop-up message or through the Rewards section.

Where any term of the offer is breached or there is evidence of a series of wagers placed by a customer or group of customers, which due to a deposit bonus, enhanced payments or any other promotional offer results in guaranteed customer profits irrespective of the outcome, whether individually or as part of a group, bet365 may reclaim the bonus or enhanced payment element of such offer, void any wager funded through the offer and/or remove any winnings from such wager. In addition, where there is evidence of such activity, bet365 may levy an administration charge on the customer up to the value of the bonus or enhanced payment towards the administrative costs incurred in identifying and taking action against that activity.

Under Spanish Personal Income Tax Law (Ley 35/2006, de 28 de noviembre, por la que se aprueba el Impuesto sobre la Renta de las Persona Físicas) if you win a prize of any value, it is your responsibility to pay any income taxes arising on the value, and for prizes where the taxable amount exceeds a certain threshold, this may require the tax to be withheld and paid on your behalf by bet365.

For non-cash prizes, to calculate the taxable amount, we take the prize’s value, increased by 20% (the gross-up). For non-cash prizes with a grossed up value below 300 €, it is your responsibility to pay any taxes arising. If the grossed-up value exceeds 300 €, bet365 will apply the required 19% withholding tax rate.

For cash prizes, these will be subject to withholding tax when the gross amount of the prize exceeds the threshold of €300. The applicable withholding tax rate for Spanish tax residents is currently 19%. The winner is responsible for declaring the full taxable amount of the prize in their annual Personal Income Tax return and may deduct the withholding tax paid on their behalf by bet365 as a withholding tax.

For this promotion, bet365 has, at its discretion, chosen to assume and pay the withholding tax directly to the Spanish Tax Agency (AEAT) on your behalf, if you win a prize that exceeds the thresholds above. This is an optional decision by bet365, as the legal obligation to pay any taxes arising from the prize lies solely with the winner. Please note that if you win a prize, the withholding tax amount that we pay on your behalf is considered additional taxable income under Spanish tax rules, increasing the total taxable value of the prize that you have received. You will need to declare this full amount in your annual personal tax return.

Where we have paid a prize over the thresholds above, we will send you a Withholding Tax Certificate, to confirm the amount of tax paid on your behalf and the full value of the prize you have received. This certificate will be made available to you [via email] before [the end of March after the annual withholding tax summary has been filed], and will help you to correctly declare the value of the prize and the tax that has already paid, when you complete your annual tax return. You are responsible for declaring the full taxable value of the prize (market value plus, where applicable, the withholding tax amount we have paid as confirmed to you in the Withholding Tax Certificate) in your annual income tax return and (if applicable) you may deduct the withholding tax paid by bet365 as a payment already made on your behalf.
